Copyright Policy (DMCA)

1. Our approach
We respect the rights of creators and expect players to do the same. FitBound lets players add a small amount of material that other players can see:
- a profile photo;
- a shared workout link: the workout's name and description, and, only if the player chooses, their notes;
- guild names, tags and descriptions;
- custom exercise names and instructions.
You may upload or write only material you own or have permission to use (Terms of Service, Section 9). We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. §512, and we close the accounts of repeat infringers (Section 7).
Meal photos you scan are not stored by FitBound (Privacy Policy, “Meal photos”), so there is nothing on our systems for a notice about them to reach.
We accommodate and do not interfere with standard technical measures that copyright owners use to identify or protect their works (17 U.S.C. §512(i)(1)(B)).
2. Our designated copyright agent
Send copyright notices and counter-notices to our designated agent:

Service provider: Sacro Media LLC, 19 Raritan Drive, Califon, NJ 07830, doing business as FitBound and FitBound Online (fitboundonline.com and the FitBound Online app). This agent is listed in the U.S. Copyright Office's DMCA Designated Agent Directory (https://dmca.copyright.gov/osp/) under registration number DMCA-1082679, registered October 11, 2026.
This address is for copyright notices and counter-notices only. For anything else, including trademark and impersonation concerns, use Report in the app or email support@fitboundonline.com.
3. Before you send a notice
- Copyright protects original works, such as photographs, artwork, video and written text. It does not protect names, titles, short phrases, slogans or facts (37 C.F.R. §202.1(a)). A username, display name, guild name or tag that uses a brand or pretends to be someone is a trademark or impersonation matter: report it in the app (choose “Copyright or impersonation”) or email support@fitboundonline.com. We handle those under the Terms of Service, not under this notice process.
- Consider whether the use is authorized. Before you send a notice, consider whether the use may be licensed, permitted by you, or allowed by law, such as fair use.
- A report in the app is not a copyright notice. It helps us review content under our Terms, but a request to remove material under copyright law must be a written notice to the agent in Section 2 with the elements in Section 4.
- False notices have consequences (Section 8).
4. What a notice must include
Under 17 U.S.C. §512(c)(3), your notice must be a written communication to our designated agent that includes substantially the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if one notice covers several works on FitBound, a representative list of them.
- Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient for us to find it: the player's username and which item it is (profile photo, shared workout link with its web address, guild name or tag with the description, or the custom exercise). A screenshot helps.
- Information reasonably sufficient for us to contact you: your postal address, telephone number and, if available, email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
If a notice is missing some of these elements but identifies the work, the material and how to reach you, we will contact you to ask for what is missing. We do not remove material on an incomplete notice.
5. What we do when we receive a valid notice
- We remove the material or disable access to it, expeditiously. By type: a profile photo is taken off the profile and moved out of the storage that other players can reach; a shared workout link stops working; a guild description is cleared; a custom exercise is renamed “Removed exercise” and its instructions are cleared.
- We tell the player who posted it, in the app and by email: what was removed, the name of the person or company that sent the notice, the work the notice identified, and how to send a counter-notice. We do not give the player your address, telephone number or email address.
- We record a copyright strike against the player's account (Section 7).
- We reply to you to confirm what we did.
6. Counter-notices
If you believe material you posted was removed or disabled by mistake or misidentification, you can send a counter-notice to our designated agent. Under 17 U.S.C. §512(g)(3), it must be a written communication that includes substantially the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before it was removed (for example, “my profile photo” or the shared workout link's web address).
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Sacro Media may be found), and that you will accept service of process from the person who sent the notice or that person's agent.
What happens next. We send a copy of your counter-notice, including your name, address and telephone number, to the person who sent the original notice, and tell them we will put the material back in 10 business days. We put the material back no sooner than 10 and no later than 14 business days after we receive your counter-notice, unless the person who sent the notice first tells our designated agent that they have filed a court action seeking to restrain you from the claimed infringement. If they have, the material stays removed while that action is pending. When material is put back after a counter-notice, the strike from that notice is removed.
Business days are Monday through Friday, excluding U.S. federal holidays, counted in U.S. Eastern Time (where Sacro Media operates).
If you have a newer profile photo by the time a photo is put back, we keep your newer one.
7. Repeat infringers
Under 17 U.S.C. §512(i)(1)(A), we have adopted, and we enforce, the following policy for the termination of repeat infringers:
- A strike is a removal of material you posted in response to a valid notice. A strike is removed if the material is put back after a counter-notice, or if the person who sent the notice withdraws it.
- Final written warning. We send a final written warning with your second strike within 12 months. We may also send it with a first strike, for example when the infringement looks deliberate or large-scale.
- Termination. We close the account of a player who receives three strikes within 12 months, or any strike after a final written warning.
- What closing means. A closed account can no longer upload photos, share workouts, or create or edit custom exercises and guild text, and may also lose other features, such as friends, trades and guilds. You can still sign in to download your data, to delete your account, and to send a counter-notice. You may not create another account to get around a termination.
- Reopening. If strikes are removed (after a counter-notice or a withdrawn notice) so that the account no longer meets this rule, we may reopen it.
- Records. We keep a record of notices, strikes and terminations, including after an account is deleted, so that this policy can be applied (Section 9).
8. Misrepresentations
Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, by a copyright owner or its authorized licensee, or by us. If you are not sure whether material infringes your copyright, or whether a removal was a mistake, consider talking to a lawyer first.
9. How long we keep removed material and records
- Removed material. We keep a copy of removed material out of public view for 90 days after removal, so that we can put it back after a valid counter-notice. We keep it longer only while a counter-notice is pending (up to 30 days after the last day we could put it back) or while a court action about it is pending. After that we delete it at our next weekly cleanup.
- Notices, counter-notices and strike records. We keep them for three years after the last action on the notice (the time limit for most copyright claims, 17 U.S.C. §507(b)), including after an account is deleted, to apply this policy and to document how we handled each claim.
The Privacy Policy describes the personal information in these records.
10. Changes and contact
We may update this policy. We will post the new version with its effective date. Copyright notices and counter-notices: the designated agent in Section 2. Everything else: support@fitboundonline.com.
